TERMS AND CONDITIONS EIGHTH: RIGHTS AND WARRANTIES

Right of Withdrawal

In the case of the contracting of services, Parque Futangue has the discretion to accept or not accept the right of withdrawal. For each service offered, the applicable policy regarding the right of withdrawal will be clearly communicated in advance.

If the good or service was obtained through credit, it will be rendered void, but any interest charges will be the responsibility of the consumer if granted by a third party.

Parque Futangue is obligated to refund the sums paid, without retention of costs, as soon as possible, and in any case, within 45 days of the communication of withdrawal. For services, the refund will only include sums paid for services that have not been provided by the date of withdrawal.

TERMS AND CONDITIONS NINTH: CANCELLATION/MODIFICATION POLICIES

For guided and self-guided activities:

  • 1. The purchase of tickets or guided tours is non-refundable. A date modification can be requested up until 5:00 PM the day before, by emailing contacto@futangue.com.
  • 2. It is the responsibility of visitors to be informed about which trails are open each month, the operating hours of the park according to the season, the last allowed access time for each trail, the accessibility and difficulty of the trails, and their locations. This information is clearly described in the “Horarios” document, available in the “Parque” section of the website, in the description of each self-guided trail, and in the “buy ticket” section. By purchasing the ticket, visitors acknowledge this document and agree that no refund will be provided in case of:
    1. Failing to arrive at the designated time for entry to the trail they intended to do or at the start time of the excursion indicated in the reservation.
    2. Not being able to access a trail because it is not open on the date of entry, as specified in the “Horarios” document.
    3. Not having a 4×4 vehicle to reach the starting point of the self-guided trail.
    4. Not reaching the correct access point where the desired trail is located.
    5. Not showing up on the day the ticket or excursion was purchased for, without having previously modified the reservation.
    6. Unfavorable weather conditions (it is the visitor’s responsibility to check the weather forecast for the date of the visit).
  • 3. The park entry is valid for one day and allows access to the open trails during the communicated operating hours, as stated in the “Horarios” document, and only for the park entry purchased.
  • 4. The park reserves the right to close access in the event of adverse weather conditions that may pose a danger to visitors, in which case a date modification or a full refund will be offered.
  • 5. Minors can only participate in guided excursions if accompanied by their parents or a responsible adult.

For hotel stays:

  • Cancellations are allowed without penalty up to 14 days before the arrival date (local check-in time). After that, 100% of the stay will be charged.
  • Modifications can be made without penalty up to 14 days before the arrival date (local check-in time). After that, 100% of the stay will be charged. If the new date has a higher rate, the customer must pay the difference. If the new date has a lower rate, the original charge will apply.
  • For reservations made less than 14 days before check-in, no cancellations or modifications without penalty are allowed.

In case of force majeure, the following conditions apply for any service contracted with Parque Futangue:

  • 20% refund of the total reservation amount.
  • If outside the previously mentioned deadlines, the reservation can be modified by presenting a medical certificate that proves the inability to travel. The certificate must be submitted when requesting the modification.

Force majeure includes: war, epidemics, quarantines, natural disasters, strikes, local civil disturbances, border closures, or similar causes beyond the control or responsibility of the hotel, making it impossible to offer the facilities. Parque Futangue will not be responsible and will not offer refunds and/or modifications due to flight cancellations or itinerary changes made by external companies.

*In case of NO SHOW, 100% of the total stay, excursion, or park entry reserved will be charged.

Other conditions for modifying reservations:

  • If modifying a date that includes a different rate than the original reservation, any possible price difference must be paid. If the new date has a lower rate, only the date will be modified, not the amount.
  • Cancellations of existing reservations to make new reservations with promotions are not accepted.
  • A reservation can only be modified once. When modifying, the original reservation policies will still apply to the new date; no refunds or further modifications will be allowed.

It is prohibited to frame or use framing techniques to enclose any trademark, logo, or other registered or patented information (including images, text, page layout, or form) of Parque Futangue without our prior written consent. Meta tags or any other “hidden text” using the name or trademarks of Parque Futangue may not be used without written permission. Parque Futangue respects the intellectual property of others. If you believe your work has been copied in such a way that it constitutes an infringement of intellectual property rights, contact us at contacto@futangue.com

TERMS AND CONDITIONS FOURTEENTH: RELEASE OF LIABILITY

The visitor to the Park or participant in a guided or self-guided tour declares that they are physically fit and in optimal health conditions to participate in the contracted activity or program or to tour the park in a self-guided manner.

Additionally, they acknowledge and accept that the contracted service may include dangerous activities, including, but not limited to: fishing, swimming, rowing, hiking, climbing, trekking, bird watching, kayaking, rafting, cycling, rappelling, motorcycling, and other similar activities. By participating, they voluntarily and explicitly assume all associated risks and acknowledge that the park is located in a remote area with difficult access, far from medical centers, and subject to adverse weather conditions.

Warnings

The park explicitly warns of the dangers of walking, running, or cycling on the trails, especially on wooden bridges, docks, and walkways due to high humidity, rain, snowfalls, fallen trees, and the general effects of weather and nature on the wooden structures exposed to the elements in the mountain, which are impossible to maintain in a condition that guarantees the safety of visitors. The park administration urges visitors to walk with extreme caution on the wooden bridges and walkways to avoid accidents.

Participants in guided and self-guided activities are not insured by the company. Participants are required to ensure they have sufficient health and accident insurance (including sports coverage).

By purchasing the service or paying for entry, the participant or customer explicitly releases Parque Futangue, its owners, managers, administrators, staff, employees, and representatives from any liability for damages they may experience, either to themselves or their property, as a result of participating in one or more activities, whether guided or self-guided, arising from an act of God, force majeure, actions of a third party, another participant, nature, or personal neglect, whether grave, light, or minimal.

Notwithstanding the above, the participant expressly waives any claim they may have for such matters against the aforementioned parties and releases them from any responsibility not attributable to them by proven gross negligence.

In any case, and where legally applicable, any indemnification will be limited to actual damages, excluding any claim for lost profits, moral damages, or indirect damages.

The customer or participant expressly consents that any doubt, difficulty, or dispute of any nature, lawsuit or claim, action, demand, etc., will be resolved by Chilean laws, and the jurisdiction for such matters will belong to the courts of the jurisdictional territory of the Court of Appeals of Santiago.

The acceptance of the terms and conditions outlined in this document also includes minors accompanying the visitor or participant.

At the park entrance, signing the liability waiver document will be mandatory to gain entry.

FIFTEENTH: PARK REGULATIONS

The park administration cannot be held responsible for any accidents resulting from natural phenomena or from negligence, lack of preparation, or reckless behavior by visitors. We have established a set of rules that you must follow when visiting for the care of the park and your safety:

  • It is prohibited to litter on the trails or in the forest. People who have picnics must take their waste out of the park without leaving any trace. Littering is considered a serious violation of the park regulations and results in a permanent ban on future entry.
  • Camping inside the park is strictly prohibited, except for guided groups with authorization from the administration.
  • The entry of camping equipment such as tents, sleeping bags, pots, and stoves is not allowed.
  • Making fires on the trails, near them, or anywhere outdoors is prohibited.
  • Smoking is prohibited inside the park.
  • The consumption of drugs and the entry of alcohol is prohibited.
  • Washing anything in the lagoons or streams is prohibited.
  • Do not alter, move, or damage the park’s infrastructure.
  • Fishing is prohibited or the entry of fishing equipment without authorization from the administration.
  • The entry of kayaks, canoes, hard or plastic boats, stand-up paddleboards, or any other type of watercraft is prohibited. All types of water toys are also banned.
  • The entry of non-park motorcycles on the trails is prohibited.
  • Pets are not allowed in the park due to the potential effects on wildlife.
  • The entry of non-park horses onto the trails is prohibited.
  • Cutting trees, flowers, ferns, or collecting any plant or animal samples from the park is prohibited. Nature must not be disturbed.
  • Do not touch reptiles, amphibians, or insects.
  • Do not feed the animals encountered on the trail or leave food outdoors, as native wildlife can become accustomed to this food and lose their wild nature.
  • Weapons are prohibited.
  • Hunting animals is prohibited.
  • The entry of drones without authorization from the administration is prohibited.
  • Park rangers are present to enforce the park regulations and are required to report any violations.
  • Parque Futangue reserves the right to permanently ban entry to those who deliberately violate the park regulations, without prejudice to legal actions that may be taken against violators and other punishments or fines imposed by administrative authorities, such as SAG or CONAF.

Trails

  • Take special care with minors, especially around docks, viewpoints, bridges, wooden walkways, and cliffs.
  • Always stay on the trail to avoid accidents and minimize the impact on fragile ecosystems.
  • Try to walk at a safe distance from ravines and cliffs.
  • Walk with caution on bridges, walkways, docks, stairs, and viewpoints, as these may be slippery or have loose boards due to constant rainfall of over 4000 mm per year.
  • Avoid leaning on or sitting on the railings of viewpoints or bridges. Only a maximum of two people at a time are allowed to cross suspension bridges.
  • Make sure to wear appropriate clothing and footwear for the weather conditions. Remember to use sturdy trekking shoes with good traction.
  • When walking on the trails, do so in groups of at least two people. Avoid separating from your group, always carry water, and have a headlamp, even if it’s just for a short day hike.
  • When hiking in a group, each member should carry hydration and food in case some get separated. Set meeting points (at the vehicle, at the trailhead, etc.).
  • Medical issues can be exacerbated by the physical exertion of hiking. Each person should know their limits and pay attention to how they respond during the hike.
  • If accumulated snow prevents you from clearly recognizing the trail, do not proceed.
  • If you encounter a wild boar or a cougar, maintain your distance and do not approach. These animals avoid people but may attack if they feel threatened.
  • Prioritize using the park’s bathroom facilities.
  • Address any questions at the park’s information center or with the park rangers before beginning your hike, and register your plans for the day.

Cyclists

  • Cyclists are required to always wear a helmet and proceed with caution to avoid accidents. Descents should be slow, giving priority to pedestrians on the trails.
  • Avoid cycling if the trail is too soft or muddy.
  • Carry a repair kit.
  • Cyclists assume full civil responsibility if an accident occurs with a walker or another cyclist on a mixed-use trail. Cyclists must take extra precautions to avoid colliding with other visitors by riding very slowly and even dismounting if there are many people on the route.

Weather

  • Weather conditions can be adverse and unpredictable in the high parts of the mountain range. Snowstorms and low temperatures are common from June to October.
  • Check the weather forecast for Riñinahue before visiting the park.
  • The Puelche or Puigua wind (strong winds from the east) significantly increases the likelihood of tree falls on the trails and the risk of fires. This phenomenon may lead to the temporary closure of the park
  • Avoid mountain summits during bad weather or electrical storms.

Fishermen

  • The fishing season begins every year on the second Friday of November and ends on the first Sunday of May the following year.
  • A valid fishing license must be carried. It can be obtained at http://pescarecreativa.sernapesca.cl/
  • Fishing is allowed only with artificial flies and barbless hooks. • Catch and release all specimens.
  • Each boat may carry up to two fishermen.
  • Cada bote puede llevar hasta 2 pescadores.
  • Visitors should always use life jackets when on watercraft.
  • Fishermen must take everything they bring with them: leftovers, trash, containers, papers, personal belongings, etc.

Tree Falls

  • Parque Futangue spans 13,500 hectares and is covered by 95% native forest.
  • Every hectare of forest loses eight cubic meters of organic material annually, whether in the form of leaves, branches, or entire trees. These trees fall for various reasons: soil conditions, insects, diseases, wind, snow, fire, human activity, etc.
  • Although the park team strives to control and remove potentially dangerous trees, it is impossible to identify all trees in time. We emphasize that safety cannot be guaranteed.

Mudslides and Landslides

  • These phenomena are not frequent on the trails but have occurred in the past following extremely intense rains, surpassing 100 mm in a single day. Mudslides are an unpredictable risk in the mountain areas. Stay alert to the surroundings.

Vehicles

  • Driving within Parque Futangue is entirely the responsibility of visitors, who must not exceed 30 km/h.
  • It is recommended to use vehicles suited for dirt roads, off-road, and high enough to avoid scraping the ground.
  • The roads are narrow, so utmost caution is required to avoid accidents with vehicles coming in the opposite direction.
  • Do not leave valuables inside the vehicle. The administration is not responsible for loss or theft.
  • If you see cyclists or people walking on the road, stop the car and wait for them to pass.
  • Avoid parking in the middle of the road when stopping at a viewpoint.
  • Only 4×4 vehicles are allowed on access roads to Pitreño (Cerro Mayo), Río Futangue, and Cerro Polloihue.
  • The administration is not responsible for scratches, dents, or any other damage to the vehicle from collisions, road conditions, tree branches, ditches, rocks, or third-party actions.

Lakes and Rivers

  • The park’s lagoons do not have lifeguards and are far from medical assistance centers. Swimming is at your own risk.
  • Wearing life jackets is mandatory when kayaking or using any other watercraft. We suggest bringing life jackets for children.
  • Water sports or swimming in the lagoons is only allowed in the summer.

Swimming in any river in the park is strictly prohibited.
